“Peter Obi didn’t consider the situation that even if he won, he couldn’t become the runner-up.” – Robert Clarke

In a recent interview with Arise TV news, Chief Robert Clarke, a distinguished Senior Advocate of Nigeria and esteemed Elder Statesman, brought to light a critical aspect of Mr. Peter Obi’s electoral strategy during his tenure as the Labour Party candidate.

Clarke’s insightful analysis sheds light on an essential, albeit often overlooked, element of the political landscape. He emphasized that Mr. Peter Obi, while pursuing his electoral petition, may not have fully considered a crucial fact that could have had far-reaching consequences for his political aspirations.

Chief Clarke’s astute observation centered around the fundamental requirement for any presidential candidate in Nigeria to secure at least 25% of the vote in a minimum of 24 out of the 36 states in the country. This stipulation, enshrined in the Nigerian Constitution, plays a pivotal role in determining the eligibility of candidates to participate in the race for the presidency. It is a measure aimed at ensuring that presidential contenders have widespread support across the diverse regions of Nigeria, thereby promoting national unity and representation.

In this context, Chief Clarke pointed out that even if Mr. Peter Obi had succeeded in his electoral petition, overturning the initial outcome of the election, he still would have faced a significant hurdle on his path to the presidency. Specifically, he would not have met the crucial requirement of securing 25% of the vote in a minimum of 24 states, as mandated by the Constitution. This omission, as per Clarke’s assessment, would have rendered him ineligible to run as the runner-up against President Bola Tinubu.

The crux of the matter lies in the fact that Mr. Peter Obi did not manage to attain the 25% threshold in any of the 35 states, as Clarke meticulously observed. In contrast, the opposition candidate, Atiku, managed to secure the necessary 25% of the vote in all 35 states. Consequently, in the eyes of the electoral rules, a scenario would have unfolded where Atiku would have emerged as the foremost contender to face President Tinubu in a potential rematch.

Chief Clarke’s incisive commentary underscores the intricate and often convoluted nature of electoral politics, particularly in a diverse and populous nation like Nigeria. Legal nuances and constitutional requirements can significantly influence the course of political events and shape the outcomes of electoral petitions. Therefore, as Chief Clarke aptly noted, legal experts and unbiased observers have much to gain from delving into the intricacies of such judgments, as they offer valuable insights into the dynamic world of Nigerian politics.
